Lawsuit Alleges Negligence

[Atlanta, GA] - The 11th Circuit Court of Appeal has revived a lawsuit against Royal Caribbean Cruises after a grandfather was charged in the death of his 18-month-old granddaughter who fell from a Royal Caribbean cruise ship. The lawsuit, filed by the child's parents, alleges that Royal Caribbean was negligent in failing to provide adequate safety measures to prevent the child from falling overboard. The child fell from the ship while it was docked in Puerto Rico in 2019. The district court had dismissed the lawsuit, but the 11th Circuit reversed that decision, ruling that the parents had stated a valid claim for negligence. The appeals court held that Royal Caribbean had a duty to take reasonable steps to prevent the child from falling overboard and that there was evidence that Royal Caribbean had breached that duty. The case is now back in the district court for further proceedings. The grandfather, Salvatore Anello, was charged with negligent homicide in the child's death. He has pleaded not guilty and is scheduled to go on trial in September. The lawsuit is being closely watched by the cruise industry, as it could have implications for the liability of cruise lines for accidents involving children.
